RESOLUTION PROCEDURES


WHO WE ARE:

NZ Pool Industry Association Disputes Resolution Committee members are Pool Professionals
with decades of experience in the construction of swimming pools in New Zealand.

 

HOW WE CAN ASSIST YOU:

 

The NZPIA Inc offers both Builders and their Customers a services in assesment, clarification, guidance and assistance in sorting out disputes relating to the construction of a swimming pool.

We offer Mediation and a solution appropriate for your circumstances and you can request
a Report which may be used in a Court of Law.

 

Cases will be inspected on-site and both sides may be interviewed. A meeting held in Auckland by three Builder Members of the Disputes Committee will digest the information and format a reasonable conclusion of fault on either side. If required, a Written Report will be supplied, which will be useful in Small Claims actions.

The NZPIA Inc has limited power over non-members complying with a ruling against them,
(i.e. expulsion) but the Report may be used as evidence in Legal proceedings.

COST:

The case analysis and any Report requested will be produced by NZMPB swiming pool professionals
There will be COSTS INVOLVED as outlined below.

COSTS WILL BE DEDUCTED FROM THE DEPOSIT and over-runs returned
COSTS IN EXCESS OF THE DEPOSIT WILL BE INVOICED TO YOU

A report will be compiled by a committee of not less than three Builder Members of the NZPIA Inc. after consideration of the evidence supplied and observed it may require speciallist members being asked to join the Disputes Committee, for which an additional charge will be incurred. On request, a Written Report sent to the applicant at extra cost. Other costs such as the following may be incurred:

1. Disputes attended outside a 300km radius of Auckland, if local Members are not available/unqualified to attend
2. Complicated disputes involving an escalation in price, especially if research & further discussion is involved
3. Witness costs

On-Site inspections usually require a minimum of two independant Members attending the site, and a follow-up Committe Meeting to discuss findings require the attendance of a minumum of three Builder Members.
 
TYPICAL COST:
Typical Auckland local dispute, costs as follow may be incurred:  
Onsite visit by two Builder Members
$     300.00 minimum charge
Inhouse meeting by three Builder Members
$     450.00 minimum charge
Report production & secretarial cost $     150.00 minimum charge
Other costs i.e. Witness fees, research costs etc. may be incurred
